Muligheten for \u00e5 bestemme dette er n\u00e5 gjort langt enklere.<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>1. Innledning<br><\/strong><br>Etter m\u00f8nster fra en rekke europeiske land, ble det i vergem\u00e5lsloven av 2013, kapitel 10 tatt inn bestemmelser om fremtidsfullmakter. En fremtidsfullmakt er en fullmakt til \u00e9n eller flere personer om \u00e5 representere fullmaktsgiveren etter at han eller hun \u2013 p\u00e5 grunn av sinnslidelse, herunder demens, eller alvorlig svekket helbred \u2013 ikke lenger er i stand til \u00e5 ivareta sine interesser innen de omr\u00e5dene som omfattes av fullmakten, jf. lovens \u00a7 78.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Kort sagt er en fremtidsfullmakt et privat alternativt til et offentlig vergem\u00e5l, og b\u00f8r vurderes av personer som ser for seg muligheten for en slik situasjon som beskrevet, enten for seg selv eller sine n\u00e6rmeste.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>2. Situasjonen uten fremtidsfullmakt<br><\/strong><br>For \u00e5 se i hvilke situasjoner en fremtidsfullmakt kan v\u00e6re til hjelp, er det naturlig \u00e5 ta utgangspunkt i hva den n\u00e6rmeste familie \u2013 \u00abn\u00e6rst\u00e5ende\u00bb \u2013 kan gj\u00f8re uten at det er avgitt noen fremtidsfullmakt fra det familiemedlemmet som er kommet i en slik situasjon som beskrevet innledningsvis, jf. lovens \u00a7 94.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Som n\u00e6rst\u00e5ende regnes f\u00f8lgende personer som har fylt 18 \u00e5r, og som ikke er under vergem\u00e5l:<br>a) ektefelle eller samboer<br>b) barn<br>c) barnebarn<br>d) foreldre<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Lovens punktvise angivelse av hvem som er n\u00e6rst\u00e5ende til et familiemedlem angir en prioritetsrekkef\u00f8lge, d v s at en n\u00e6rst\u00e5ende har bare representasjonsrett dersom samtlige medlemmer med h\u00f8yere prioritet etter den angitte rekkef\u00f8lgen, skriftlig har frasagt seg retten til \u00e5 representere familiemedlemmet.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Uten fremtidsfullmakt har den n\u00e6rst\u00e5ende rett til p\u00e5 det aktuelle familiemedlemmets vegne<br>\u2022 \u00e5 foreta \u00f8konomiske disposisjoner som gjelder familiemedlemmets bolig og daglige underhold, og<br>\u2022 \u00e5 s\u00f8rge for betaling:<br>\u2013 av offentlige skatter og avgifter<br>\u2013 av forpliktelser som f\u00f8lger av gyldige l\u00e5neavtaler familiemedlemmet har inng\u00e5tt.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>N\u00e6rst\u00e5ende representasjonsrett etter denne paragrafen gjelder ikke hvis det er oppnevnt verge for familiemedlemmet, og heller ikke i den utstrekning forholdet omfattes av en fremtidsfullmakt.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>3. N\u00e5r kommer en fremtidsfullmakt til anvendelse?<br><\/strong><br>Der det foreligger en fremtidsfullmakt f\u00e5r den virkning etter at fullmaktsgiverens rettslige handleevne er tapt.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Det er lagt til rette for to typetilfeller av fremtidsfullmakter:<br>a. Fullmakt p\u00e5 det \u00f8konomiske omr\u00e5det som skal tre i kraft fra opprettelsen eller et annet tidspunkt og f\u00f8r fullmaktsgiveren har mistet handleevnen, og som deretter skal fortsette \u00e5 gjelde etter at handleevnen er tapt. (Vedvarende fullmakter).<br>b. Fullmakt p\u00e5 det \u00f8konomiske og\/eller personlige omr\u00e5det som f\u00f8rst skal tre i kraft n\u00e5r handleevnen til fullmaktsgiver er tapt (De \u00abrene\u00bb fremtidsfullmakter).<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>4. Krav til fullmakten<br><\/strong><br>For begge former for fremtidsfullmakt m\u00e5 formkravene i lovens \u00a7 81 v\u00e6re oppfylt for at fullmakten skal v\u00e6re gyldig som fremtidsfullmakt. Videre er det et krav om at fullmakten klart m\u00e5 klart angi at den skal gjelde etter at fullmaktsgiveren har blitt ute av stand til \u00e5 ivareta sine interesser.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Fremtidsfullmakter kan bare opprettes med sikte p\u00e5 en fremtidig situasjon der sinnslidelse eller alvorlig svekket helbred gj\u00f8r fullmaktsgiver ute av stand til \u00e5 ivareta sine interesser. De situasjoner som er beskrevet omfatter alle former for alvorlig helsesvikt som kan medf\u00f8re at en person ikke selv kan ivareta sine interesser.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>En fremtidsfullmakt kan ikke opprettes med sikte p\u00e5 en situasjon der fullmaktsgiver kun er fysisk frav\u00e6rende.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>5. Hvem kan v\u00e6re fullmektig?<br><\/strong><br>Kun fysiske personer kan utpekes til fullmektig i en fremtidsfullmakt. Det kan imidlertid utpekes flere fullmektiger. Fullmakten kan ogs\u00e5 utpeke en annen (subsidi\u00e6r) fullmektig for det tilfellet at fullmektigen blir midlertidig eller varig forhindret fra \u00e5 utf\u00f8re sitt oppdrag.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>6. Hva kan fullmakten omfatte?<br><\/strong><br>En fremtidsfullmakt kan omfatte b\u00e5de \u00f8konomiske og personlige forhold. Den kan ogs\u00e5 begrenses til \u00e5 gjelde bestemte omr\u00e5der.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>\u00d8konomiske forhold kan blant annet omfatte:<br>a. kj\u00f8p og salg av eiendeler<br>b. betaling av gjeld og andre utgifter<br>c. forsikringssp\u00f8rsm\u00e5l<br>d. h\u00e5ndtering av bankkonti og selvangivelse<br>e. s\u00f8knader om \u00f8konomiske ytelser p\u00e5 fullmaktsgiverens vegne<br>f. mottak eller avslag p\u00e5 falt arv p\u00e5 fullmaktsgiverens vegne<br>g. investering av fullmaktsgiverens midler.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>En fremtidsfullmakt kan ogs\u00e5 gi fullmektigen myndighet vedr\u00f8rende fullmaktsgiverens personlige forhold. Dette kan blant annet omfatte hvor fullmaktsgiveren skal bo, hvilke fritidsaktiviteter han eller hun skal delta i, inng\u00e5else av lege- og tannlegeavtaler, innlevering av klager p\u00e5 trygdeytelser og behandling p\u00e5 fullmaktsgiverens vegne.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>7. Formkrav til fremtidsfullmakten<br><\/strong><br>Det skal g\u00e5 klart frem av fullmakten at den skal gjelde etter at fullmaktsgiveren har kommet i en tilstand som nevnt i definisjonen i lovens \u00a7 78 \u2013 jf. punkt 1 over. Ellers er fullmakten undergitt de samme formkrav som for testamenter. Det inneb\u00e6rer at fullmakten skal gj\u00f8res skriftlig med to vitner som fullmaktsgiveren har godtatt, og som er til stede sammen og vet at dokumentet skal v\u00e6re en fremtidsfullmakt. Mens vitnene er til stede, skal fullmaktsgiveren skrive under dokumentet eller vedkjenne seg sin underskrift. Vitnene skal deretter underskrive dokumentet mens fullmaktsgiveren er til stede, og etter hans eller hennes \u00f8nske. Selv om det ikke er et formkrav, b\u00f8r fullmakten dateres.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>8. Ikrafttredelse av fullmakten<br><\/strong><br>En fremtidsfullmakt trer i kraft n\u00e5r fullmaktsgiveren er kommet i en slik tilstand som beskrevet i punkt 1 over. Det er som utgangspunkt fullmektigen selv som skal ta stilling til n\u00e5r fullmaktsgiver er kommet i en slik situasjon at fullmakten er i kraft.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Fullmektigen skal snarest mulig underrette fullmaktsgiveren og fullmaktsgiverens ektefelle eller samboer om fullmaktens ikrafttredelse og om dens innhold. Hvis fullmaktsgiveren ikke har ektefelle eller samboer, skal andre n\u00e6re slektninger underrettes. Hvis det er tvil om fullmaktsgivers tilstand, kan man be fylkesmannen om stadfestelse for at fullmakten er tr\u00e5dt i kraft.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>9. Fullmektigens oppgaver<br><\/strong><br>Fullmektigen skal handle i samsvar med fullmakten og fremme fullmaktsgiverens interesser og rettigheter, jf. lovens \u00a7 85. F\u00f8r fullmektigen treffer avgj\u00f8relser av betydning skal fullmaktsgiveren h\u00f8res, hvis dette kan skje uten betydelige vanskeligheter. Det er ikke n\u00f8dvendig \u00e5 h\u00f8re fullmaktsgiveren hvis han eller hun ikke kan forst\u00e5 sakens betydning.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Fullmektigen skal holde fullmaktsgiverens midler atskilt fra sine egne. Fullmektigen skal for \u00f8vrig oppbevare tilstrekkelig dokumentasjon rundt de avgj\u00f8relser som blir tatt p\u00e5 fullmaktsgiverens vegne.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>En fullmektig kan gi \u00absedvanlige gaver\u00bb p\u00e5 fullmaktsgiverens vegne. Andre gaver kan bare gis hvis det er angitt s\u00e6rskilt i fullmakten.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Om ikke noe annet er avtalt eller fastsatt i fullmakten, kan fullmektigen dekke sine n\u00f8dvendige utgifter av fullmaktsgiverens midler og \u2013 n\u00e5r det er rimelig \u2013 ogs\u00e5 beregne seg et passende vederlag.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>10. Tilbakekall av fremtidsfullmakt<br><\/strong><br>Fullmaktsgiveren kan tilbakekalle fremtidsfullmakten hvis han eller hun har evnen til \u00e5 forst\u00e5 betydningen av dette. Et l\u00f8fte fra fullmaktsgiver om ikke \u00e5 tilbakekalle en fremtidsfullmakt er ikke bindende.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>11. Forholdet til vergem\u00e5l<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>De som er nevnt i vergem\u00e5lsloven \u00a7 56 kan begj\u00e6re at fullmaktsgiveren settes under vergem\u00e5l. Dette er f\u00f8rst og fremst fullmaktsgivers n\u00e6rst\u00e5ende, behandlende lege eller tilsynslege p\u00e5 institusjon. Det samme kan den som i fremtidsfullmakten er utpekt som fullmektig.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Videre kan fylkesmannen av eget tiltak behandle sak om opprettelse av vergem\u00e5l for fullmaktsgiveren.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Fylkesmannen eller tingretten skal vurdere om vilk\u00e5rene for vergem\u00e5l er oppfylt, jf. vilk\u00e5rene i lovens kapittel 4. Ved vurderingen av om det er behov for vergem\u00e5l, skal det legges vekt p\u00e5 om fullmektigen ivaretar fullmaktsgiverens interesser som forutsatt i fremtidsfullmakten, og om det er behov for ytterligere bistand.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>12. Oppsummering. Hvem b\u00f8r vurdere \u00e5 avgi fremtidsfullmakt?<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Muligheten for \u00e5 avgi fremtidsfullmakter er fortsatt lite kjent i Norge. Det m\u00e5 imidlertid antas at en slik fullmakt kan v\u00e6re et nyttig instrument i en situasjon hvor b\u00e5de fullmaktsgiver og n\u00e6rst\u00e5ende er tjent med en noe mer dynamisk forvaltning av fullmaktsgivers \u00f8konomiske og personlige forhold enn det offentlige vergem\u00e5lsinstituttet kan tilby. Ikke minst gjelder dette for personer som styrer betydelige formuer, og der kanskje familieforholdene er kompliserte.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Fremtidsfullmakt er imidlertid ikke bare aktuelt for personer med stor formue. Det er noe som sv\u00e6rt mange b\u00f8r vurdere, og man forventer at opprettelsen av slike fullmakter her i landet vil eskalere i \u00e5rene fremover.
