Tidligere var det Tolletaten som satt med ansvaret for avgiftene, som utgj\u00f8r om lag 100 milliarder kroner i proveny.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Overf\u00f8ringen til Skatteetaten er imidlertid ingen garanti for at rettssikkerhet sikres, og flere nye eksempler viser \u00e5penbare svakheter b\u00e5de med lovverket og hvordan Skatteetaten forvalter ansvaret.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Et grunnleggende prinsipp er at staten ikke kan kreve avgift uten forankring i lov. Skatteetaten tapte nylig en sak i Oslo tingrett hvor sp\u00f8rsm\u00e5let var om et produkt skulle anses som avgiftspliktig sm\u00f8reolje. Produktet besto av 70 prosent vann, inneholdt ikke olje, men kunne ha en sm\u00f8rende effekt som mange andre v\u00e6sker.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>For \u00e5 v\u00e6re avgiftspliktig m\u00e5tte det dreie seg om en mineraloljebasert sm\u00f8reolje eller et \u00abtilsvarende produkt av annen opprinnelse\u00bb. Staten mente avgift kunne ilegges gjennom en s\u00e5kalt utvidende fortolkning av den vage ordlyden \u2013 selv om produktet ikke var en \u00abolje\u00bb. Det ble ogs\u00e5 ilagt straffeavgift. Oslo tingrett var imidlertid ikke enig med Skatteetaten, og mente at hverken ordlyd, rettspraksis eller forvaltningspraksis st\u00f8ttet Skatteetatens tolkning. Form\u00e5lsbetraktninger tilsa at produktet ikke var avgiftspliktig. Staten anket ikke dommen, og den er derfor rettskraftig.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>I saker med tvil om tolkningen, b\u00f8r Skatteetaten for det f\u00f8rste arbeide med \u00e5 f\u00e5 regelverket presisert og i alle fall gj\u00f8re sin tolkning kjent f\u00f8r den gis virkning. Og under enhver omstendighet m\u00e5 det ikke ilegges straffeavgift. Bare en slik praksis vil skape forutsigbarhet og gi legitimitet til systemet.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Et eksempel p\u00e5 uheldig regelutforming gjelder beslutningsgrunnlaget for redusert avgiftssats p\u00e5 elektrisk kraft. Avgiften er 16,58 \u00f8re per kWh, mens redusert sats er 0,48 \u00f8re per kWh. Avgj\u00f8rende for \u00e5 f\u00e5 redusert sats er i noen henseender hva bedriftens n\u00e6ringskode er i Enhetsregisteret. Enhetsregisteret foretar klassifiseringen av n\u00e6ringskode basert p\u00e5 bedriftens vedtektsfestede form\u00e5l. Vi har erfart at Enhetsregisteret har registrert bedrifter med feil n\u00e6ringskode, men likevel f\u00f8lger det av regelverket at avgiftssatsen f\u00f8rst endres og gis virkning fra det tidspunktet koden korrigeres. Og dette selv om det er Enhetsregisteret som st\u00e5r bak feilen.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Vi stiller oss undrende til om n\u00e6ringskodene er egnet som beslutningsgrunnlag for redusert sats. Det minste man kan forvente er at Skatteetaten informerer om konsekvensene av hvilken n\u00e6ringskode en bedrift registreres med.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Et annet eksempel som ogs\u00e5 gjelder avgift p\u00e5 elektrisk kraft, er den avgiftspliktiges adgang til \u00e5 rette eller klage. Det er et grunnleggende rettssikkerhetsprinsipp at den som ber\u00f8res av et inngrep kan be om endring eller klage. Dette fremkommer ogs\u00e5 av skatteforvaltningsloven. S\u00e6ravgiftssystemet legger opp til at nettselskapet baserer fakturering av avgift (med enten ordin\u00e6r eller redusert sats) p\u00e5 dokumentasjon fra bedriften. Dokumentasjonen kan gjelde n\u00e6ringskode eller andre forhold.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Har bedriften gjort feil i den dokumentasjon som er levert nettselskapet og skulle hatt redusert avgiftsats, er det imidlertid nettselskapet som i s\u00e5 fall skal foreta endring eller klage, og ikke den avgiftspliktige selv. Noen nettselskaper er sitt ansvar bevisst og foretar endring eller klage, mens andre nettselskaper ikke vil foreta slik endring med begrunnelse at det er bedriften selv som er ansvarlig for at levert dokumentasjon er riktig. Slik fratas i realiteten den avgiftspliktige sin rett til \u00e5 endre eller klage p\u00e5 avgiftssatsen. Skattekontoret trekker i slike tilfeller p\u00e5 skuldrene, og svarer at de ikke kan gj\u00f8re noe s\u00e5 lenge nettselskapet ikke vil foreta endring. Dette er neppe i tr\u00e5d med skatteforvaltningsloven eller de prinsipper som skal sikre god saksbehandling.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Kjernen i rettssikkerhetsbegrepet er at like tilfeller behandles likt og at vedtak i forvaltningen m\u00e5 ha hjemmel i lov. Skattesystemet er ikke perfekt, men tilliten opprettholdes gjennom nettopp forutberegnelighet og en mulighet for skattyter til \u00e5 klage og g\u00e5 til domstolene. Slik utvikles ogs\u00e5 skattelovverket gjennom presiseringer, utarbeidelser av h\u00e5ndb\u00f8ker og s\u00e5 videre.
