I dette det ligger at virksomheter utenfor Europa, som behandler slike opplysninger om personer tilh\u00f8rende land i EU\/E\u00d8S, ogs\u00e5 er forpliktet til \u00e5 f\u00f8lge reglene.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Personopplysninger er informasjon som p\u00e5 en eller annen m\u00e5te kan knyttes til et individ, b\u00e5de direkte og indirekte. Med andre ord&nbsp;vil omtrent&nbsp;alle virksomheter i Norge, som p\u00e5 en eller annen m\u00e5te behandler eller oppbevarer personopplysninger (om kunder, ansatte etc.), omfattes av det nye regelverket.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Hva m\u00e5 gj\u00f8res?<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Med&nbsp;rundt hundre artikler er den nye forordningen noks\u00e5 omfattende, men vi vil r\u00e5de alle virksomheter til at man setter av n\u00f8dvendige ressurser til \u00e5 sette seg inn i reglene og identifisere hvilke konsekvenser det nye regelverket f\u00e5r for din virksomhet.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Det anbefales&nbsp;at man skaffer seg oversikt over de krav som trer i kraft fra mai 2018, at man gjennomg\u00e5r egne rutiner og skaffer seg en oversikt over hvilke personopplysninger man behandler og samtidig hvor disse oppbevares og lagres. Det er selvsagt en fordel dersom man har etterlevd dagens regelverk frem til n\u00e5. Da vil man allerede ha gode rutiner innarbeidet og dokumentasjon tilgjengelig. Dersom man ikke har oppfylt kravene i dagens lovgivning er det en del mer forarbeid som m\u00e5 gj\u00f8res for \u00e5 komme p\u00e5 et tilfredsstillende niv\u00e5.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>De nye personvernreglene gj\u00f8r det n\u00f8dvendig for offentlige virksomheter \u00e5 stille krav til sine leverand\u00f8rer med tanke p\u00e5 etterlevelse av regelverket der slike leverand\u00f8rer vil komme i kontakt med eller \u00abbehandle\u00bb personopplysninger p\u00e5 vegne av virksomheten. For eksempel vil offentlige virksomheter i den forbindelse kunne stille krav til at tilbydere ved offentlige anskaffelser dokumenterer etterlevelse av regelverket. Vi ser ogs\u00e5 at det er et stadig \u00f8kende fokus blant privatkunder&nbsp;i forbindelse med&nbsp;virksomheters bruk av kundeinformasjon. F\u00f8lgelig vil det v\u00e6re et betydelig konkurransefortrinn for din virksomhet om dere har oversikt og kontroll p\u00e5 dette, og kan dokumentere gode rutiner og systemer for h\u00e5ndtering av personopplysninger.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Fra mai 2018 m\u00e5 man ha oversikt over hvor og hvordan man lagrer personopplysninger. For eksempel vil dette v\u00e6re avgj\u00f8rende i de tilfellene en privatperson tar kontakt med virksomheten for \u00e5 f\u00e5 alle sine personopplysninger slettet.&nbsp;Retten til \u00e5 f\u00e5 sine personopplysninger slettet&nbsp;fremg\u00e5r klarere&nbsp;i det nye regelverket.&nbsp;Det blir ogs\u00e5 strengere krav til hvordan man h\u00e5ndterer avvik, herunder n\u00e5r det skal varsles, hva varselet skal inneholde og hvem som skal varsles.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Oppgaven med \u00e5 s\u00f8rge for at man etterlever og opptrer i samsvar med de nye reglene kan l\u00f8ses p\u00e5 flere m\u00e5ter, men enten man benytter seg av intern eller ekstern kompetanse, er det sentralt at man skaffer seg oversikt, foretar risikovurderinger og implementerer gode rutiner og systemer for etterlevelse av de nye reglene til enhver tid.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Personvernombud<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>I f\u00f8lge dagens lovgivning er ikke virksomheter pliktet til \u00e5 ha et personvernombud. Dette endres fra mai 2018, ved at alle offentlige og mange private virksomheter p\u00e5legges \u00e5 ha et personvernombud. Personvernombudet skal p\u00e5se at virksomheten oppfyller de krav som stilles etter ny lov. Videre skal personvernombudet v\u00e6re et bindeledd mellom virksomheten, de som er registrert med personopplysninger og Datatilsynet. Det er viktig \u00e5 merke seg at selv om man har et personvernombud, er det virksomhetens ledelse som utad har ansvaret for etterlevelse av regelverket. Ombudet kan v\u00e6re en ansatt eller en ekstern innleid konsulent, og man b\u00f8r vurdere fordelene ved \u00e5 opprette en slik stilling selv om man i utgangspunktet ikke plikter det. Personvernombudet skal ha en&nbsp;uavhengig&nbsp;rolle, og fritt kunne p\u00e5peke og veilede ledelsen om aktuelle forhold internt i bedriften. Vedkommende skal ogs\u00e5 involveres i bedriftens prosesser der personvernrettslige forhold aktualiserer seg, for eksempel om man skal igangsette nye former for bruk av en eksisterende kundedatabase, eller at innsamlede personopplysninger skal brukes til nye form\u00e5l.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Sanksjoner<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Ved brudd p\u00e5 reglene, vil man, foruten et omd\u00f8mmetap, risikere langt strengere sanksjoner fra Datatilsynet enn hva som har v\u00e6rt praktisert frem til n\u00e5. Dersom det avdekkes grove brudd p\u00e5 reglementet, vil man i ytterste konsekvens risikere administrative b\u00f8ter p\u00e5 opptil 20 millioner euro eller 4% av foretakets \u00e5rlige omsetning i forutg\u00e5ende regnskaps\u00e5r, der h\u00f8yeste bel\u00f8p anvendes.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Det gjenst\u00e5r selvsagt \u00e5 se hvilket niv\u00e5 Datatilsynet vil legge seg p\u00e5, og om selskaper i tillegg risikerer \u00e5 bli utestengt fra anbudsprosesser \u2013 som i saker hvor et foretak har gjort seg skyldig i korrupsjon.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Fordeler?<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Dersom&nbsp;man kan vise til at det er gjennomf\u00f8rt risikovurderinger eller andre tiltak for \u00e5 etterleve de nye reglene, vil man skape b\u00e5de trygghet og tillit til n\u00e5v\u00e6rende og fremtidige kunder.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>En grundig gjennomgang av selskapets rutiner for etterlevelse av de nye personvernreglene, vil ofte medf\u00f8re at det etableres standardiserte systemer og arbeidsprosesser som kan gj\u00f8re virksomhetens drift mer effektiv og kostnadsbesparende.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><em>Dersom man er usikker p\u00e5 hvilken betydning de nye reglene vil ha for sin virksomhet, og \u00f8nsker r\u00e5d eller veiledning, har advokatfirmaet Hammervoll Pind AS kompetanse til \u00e5 bist\u00e5 med dette.&nbsp;<\/em><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Medforfatter:&nbsp;Magnus A. This includes assistance during the drafting of sales contracts and follow-up of these, as well as assistance in closing transactions. It is very common that ship purchases are financed through loans and\/or by issuing bonds. Our lawyers assist shipping companies with these types of financing. We also have extensive experience with the challenges that may arise in connection with transferring ships from one ship register to another.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2><strong>Construction contracts<\/strong><\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>For new builds and ship repairs, the shipbuilding contract will set the framework for the delivery. A focus on precise and realistic contractual provisions is vital for ensuring contractual compliance at the agreed time. Deficiencies and delays on delivery can often be extremely costly for both shipyards and shipping companies. Our lawyers have extensive experience with these types of contract negotiations, as well as follow-up during the construction period, to ensure that new builds are constructed as agreed. Our lawyers also assist with dispute cases if the parties are unable to reach an agreement, including with litigation before the ordinary courts and arbitral tribunals.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2><strong>Arrest and securing of claims<\/strong><\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Security in ships and securing claims against ships or owners are more complex than, for example, real estate. This has a clear connection to the ship\u2019s freedom of movement and thereby the opportunity to avoid the claim being secured. Incorrect arrests can also result in major losses for the ship\u2019s owner. Our lawyers have assisted shipping companies and finance institutions in connection with such arrests, both in Norway and in other jurisdictions.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2><strong>Management agreements<\/strong><\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Many ships and offshore installations have long-term operational and maintenance agreements.
