Blanketten er basert p\u00e5 bustadoppf\u00f8ringslovas regler og legger til grunn at entrepren\u00f8ren p\u00e5tar seg det meste av planleggingen og oppf\u00f8ringen av boligen eller fritidseiendommen.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Arbeid relatert til oppf\u00f8ring av bolig eller fritidsbolig<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Byggblankett 3426 A:2011 og 3426 B:2019 gjelder utf\u00f8relse av arbeid relatert til oppf\u00f8ring av bolig eller fritidsbolig. Byggblanketten er basert p\u00e5 bustadoppf\u00f8ringslovas regler og forutsetter at forbrukeren leverer tegningsgrunnlaget. A gjelder i de tilfeller hvor vederlaget for byggearbeidet er lavere enn 2 ganger grunnbel\u00f8pet (G), og B gjelder n\u00e5r avtalt vederlag er h\u00f8yere enn 2G. Grunnbel\u00f8pet er per 1. mai 2018 kroner 96.883, og 2G utgj\u00f8r kroner 193.766.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Bolig eller fritidsbolig hvor arbeidet ikke er fullf\u00f8rt<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Byggblankett 3427:2019 er basert p\u00e5 bustadoppf\u00f8ringslovas regler og benyttes for kj\u00f8p av bolig eller fritidsbolig i de tilfeller hvor arbeidet ikke er fullf\u00f8rt. Dersom arbeidet er fullf\u00f8rt benyttes byggblankett NS 3428:2019 som er basert p\u00e5 avhendingslovas regler.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Arbeid som utf\u00f8res p\u00e5 fast eiendom<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>For arbeid som utf\u00f8res p\u00e5 fast eiendom benyttes byggblankettene 3501:2013 eller 3502:2013. Disse er tilgjengelige p\u00e5&nbsp;<a href=\"https:\/\/www.forbrukerradet.no\/\">Forbrukerr\u00e5dets<\/a>&nbsp;nettsider. Byggblankett 3501 benyttes for arbeider p\u00e5 fast eiendom hvor det avtalte vederlaget er h\u00f8yere enn 2G. Byggblankett 3502 gjelder n\u00e5r vederlaget er lavere enn 2G.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Oppf\u00f8ring av bolig eller fritidsbolig p\u00e5 tomt med byggeklausul<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Byggblankettene 3429 A:2019 og 3429 B:2019 er basert p\u00e5 bustadoppf\u00f8ringslova og gjelder for tomter med byggeklausul. Blankett A gjelder for kontrakt om rett til slik tomt og B gjelder for kontrakt om planlegging og oppf\u00f8ring av bolig eller fritidsbolig p\u00e5 slik tomt.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Kj\u00f8p av prefab til bolig og andre bygninger<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Byggblankett 3404:2009 er basert p\u00e5 forbrukerkj\u00f8psloven og gjelder for kontrakt om kj\u00f8p av byggesett til bolig og andre bygninger.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading {\"level\":3} -->\n<h3>Oppdrag mellom profesjonelle akt\u00f8rer<\/h3>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Mellom profesjonelle parter er det ogs\u00e5 utarbeidet standard kontraktsformularer, eller byggblanketter. Flere av disse er i tillegg tilgjengelige som engelske versjoner.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Prosjektering, r\u00e5dgivning og byggelederoppdrag<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Ved prosjekteringsoppdrag benyttes byggblankett 8401 eller 8402, som er basert p\u00e5 henholdsvis NS 8401 og NS 8402. Byggblankett 8403 gjelder ved inng\u00e5else av byggelederoppdrag i henhold til NS 8403. Ved bruk av NS 8403 anvendes ogs\u00e5 byggblankett 8440 A og B som gjelder henholdsvis kontraktformular og formular for oppgavefordeling mellom byggherre og hans eller hennes kontraktspartner.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Utf\u00f8relsesentreprise<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Ved utf\u00f8relsesentreprise anvendes NS 8405 eller NS 8406 mellom byggherre og entrepren\u00f8ren som skal utf\u00f8re arbeidene. Det er tre byggblanketter for hver av standardene. Byggblankett 8405 og 8406 A er formular for inng\u00e5else av kontrakten, mens byggblankett 8405 og 8406 B og C er formularer for henholdsvis entrepren\u00f8rens og byggherrens sikkerhetsstillelse. Som hovedregel b\u00f8r NS 8405 med tilh\u00f8rende blanketter benyttes.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Ved utf\u00f8relsesunderentreprise mellom utf\u00f8relsesentrepren\u00f8r og underentrepren\u00f8r benyttes standardene NS 8415 eller NS 8416. Her er det ogs\u00e5 tre byggblanketter med samme anvendelsesomr\u00e5der som NS 8405 og NS 8406.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Totalentreprise<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Ved totalentreprise, hvor totalentrepren\u00f8ren b\u00e5de skal prosjektere og utf\u00f8re arbeidene, benyttes NS 8407 mellom byggherre og totalentrepren\u00f8r. Her er det tre tilh\u00f8rende byggblanketter A, B og C som gjelder kontraktsinng\u00e5else og sikkerhetsstillelse.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Ved totalunderentreprise i henhold til NS 8417, som brukes mellom totalentrepren\u00f8r og underentrepren\u00f8r, er det ogs\u00e5 tre byggblanketter som f\u00f8lger standarden NS 8417. Disse har samme anvendelsesomr\u00e5der som byggblankettene til NS 8407.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>For kj\u00f8p av byggevarer<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>For kj\u00f8p av byggevarer benyttes byggblankett NS 8409, som reguleres av NS 8409. For \u00f8vrig kan nevnes at Standard Norge ogs\u00e5 har byggblanketter til bruk ved innkalling til overtakelsesforretning, overtakelsesprotokoll og mangelliste med forbrukere. Disse er byggblankett 8430 C, D og E. Overtakelsesprotokoll og mangelliste mellom profesjonelle er byggeblankett 8430 A og B.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Etter \u00e5 ha valgt korrekt byggblankett, b\u00f8r man bruke tid til \u00e5 fylle inn presis informasjon om pris, forsikringer, tidsfrister, partenes representanter med mer. Dette kan v\u00e6re tidskrevende i starten, men l\u00f8nnsomt i det lange l\u00f8p. This includes assistance during the drafting of sales contracts and follow-up of these, as well as assistance in closing transactions. It is very common that ship purchases are financed through loans and\/or by issuing bonds. Our lawyers assist shipping companies with these types of financing. We also have extensive experience with the challenges that may arise in connection with transferring ships from one ship register to another.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2><strong>Construction contracts<\/strong><\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>For new builds and ship repairs, the shipbuilding contract will set the framework for the delivery. A focus on precise and realistic contractual provisions is vital for ensuring contractual compliance at the agreed time. Deficiencies and delays on delivery can often be extremely costly for both shipyards and shipping companies. Our lawyers have extensive experience with these types of contract negotiations, as well as follow-up during the construction period, to ensure that new builds are constructed as agreed. Our lawyers also assist with dispute cases if the parties are unable to reach an agreement, including with litigation before the ordinary courts and arbitral tribunals.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2><strong>Arrest and securing of claims<\/strong><\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Security in ships and securing claims against ships or owners are more complex than, for example, real estate. This has a clear connection to the ship\u2019s freedom of movement and thereby the opportunity to avoid the claim being secured. Incorrect arrests can also result in major losses for the ship\u2019s owner.
